  1. Introduction
    • Good Mood, Lda (hereinafter referred to as “Good Mood”) strongly believes in protecting the confidentiality and security of the Personal Data of the people with whom it relates in the exercise of its activity. Good Mood expresses its firm commitment to comply with current legislation in the handling of Personal Data in accordance with this Privacy Policy.
    • The specific Personal Data that will be processed and the way in which it will be used depends to a large extent on the services requested by you and agreed with you. This Privacy Policy applies to the Personal Data of our Clients, Users of our website and Suppliers, whenever these are individuals.
    • Good Mood respects the privacy of the individuals with whom it interacts in the exercise of its activity and protects their Personal Data. Most of the website boomfestival.org can be browsed without the User sharing any information. This document informs you of the use that Good Mood makes of your Personal Data whenever necessary to provide its services. You may check our Cookies Policy here.

    • Good Mood reserves the right to modify the Privacy Policy in light of new legal and/or regulatory requirements, for security reasons or for the purpose of adapting the said Privacy Policy to the instructions of authorities in terms of data protection.
    • This Privacy Policy applies to any use of the boomfestival.org website and to any commercial transaction carried out on it. The User and/or Client must additionally consult the Terms and Conditions of that website.
    • When you register on the boomfestival.org website, there is information therein that can be transmitted. This transmission results from the services contracted by you with third parties.     • Whenever beginning with a capital letter, the following terms will have the following definition:

  3. Clients: customers and others to whom Good Mood supplies goods or provides services during its activity on the online store boomfestival.org.

  1. What data do we collect, how we use it and on what basis
    • Good Mood collects different types of Personal Data for different purposes, as explained below. In any case, we emphasize that we do not intentionally collect personal information from persons under 18 years of age. In case we detect that we involuntarily collected personal information from anyone under the age of 18, we will take the necessary steps to delete the information as quickly as possible, unless we are required by applicable law to retain it.

  2. CLIENTS: We only collect Personal Data necessary for the preparation, fulfilment and execution of any contract entered into between the Client and Good Mood, as well as to respond to any subsequent complaints regarding the same, namely:
  • Identifying data: such as name, date of birth, and contact details (phone and email);
  • Payment and/or order processing data: tax identification number (VAT number), billing address and shipping address;
  • Authentication data: such as client ID and password to log-in in the client area.

We may also collect information relating to your online activity, which we use to ensure that the marketing communications we direct to you are relevant and timely, in accordance to the consent you have given us. We may also have information that you choose to share with us (evaluation of our services and products, allergies, physical and health conditions and dietary restrictions). If, for any reason, we need any additional personal data, you will be informed. Good Mood uses a contact form for Clients that is processed by JOTFORM (see point 5.6. of this Privacy Policy).

  1. PROVIDERS: We only collect Personal Data necessary for the preparation, fulfilment and execution of any contract entered into between the Supplier and Good Mood, as well as to respond to and manage any claims related thereto. We will collect Personal Data from contact persons, including those from your company, such as names, telephone numbers and email addresses. We will also collect bank details so that we can pay you. We may also have information that, directly or through someone from your company, you have decided to share with us.
  2. USERS: We only collect the Personal Data necessary to ensure a good experience using the website bazaar.boomfestival.org and to allow you to enjoy all the potential and faculties provided by it, as well as, to help us manage the services we provide. This includes information such as how you use our website, the products you view, which websites or search terms brought you to our website, how often you access it, your browser type, your IP address, the location from which you browse our website, the language you choose to view it and the times when our website is most popular. This information is collected through different technologies, better described in section 5. and section 6. of this Privacy Policy.

3.3. Good Mood uses the information provided by the Client on the website bazaar.boomfestival.org exclusively to satisfy their requests for products and services:

  1. Whenever the Client carries out an ordering process, Good Mood collects his/her Personal Data for the purpose of selling, sorting and transporting the ordered products;
  2. Whenever the Client requests after-sales assistance, his/her Personal Data is collected with the aim of providing him/her with specific client support services.

3.4 All services that include automated emails (newsletters) are only activated after prior express authorization from the User and/or Client, who will always have an option to unsubscribe.

 

  1. I have an obligation to provide my Personal Data
    • Within the scope of our business relationship, you will have to provide your Personal Data necessary to establish and create that relationship and to comply with the obligations and pre-contractual and contractual measures derived from it, as well as those that we are legally obliged to collect. Without this data, we will, as a general rule, have to refuse the conclusion or execution of the contract or we will not be able to keep the contract and will have to terminate it.

Google Analytics compiles data such as, for example, which website the User came from, how long he/she stayed on the website bazaar.boomfestival.org, what type of computer and browser he/she is using. The tracking information collected by Google Analytics allows us to better understand the type of Users who visit the bazaar.boomfestival.org and what content they are reading.   1. Who are the recipients of your Personal Data
  • Personal Data is not shared with third parties without your prior and express permission, unless we are obliged to do so by applicable law.
  • However, prior express permission may be requested from the User to authorize Good Mood to give the User's personal information to third parties, only and when necessary to provide the product or service requested, and the User is guaranteed that only the minimum information necessary to satisfy the request is shared, restricted only to the data necessary for the execution of the contracted tasks.
  • Good Mood also guarantees that these third parties are committed, under current legislation, not to reveal, in any way, Personal Data, nor to use them for purposes other than the provision of contracted services.
  • Likewise, Good Mood may communicate your Personal Data, when so determined by law, in the context of legal proceedings or in the context of investigations of suspicious activities.
  • Good Mood will in no case carry out international transfers of your data to a third country or international organization located outside the European Union.
  • Good Mood does not knowingly collect personal information from anyone under 18 years of age. If Good Mood detects unintentional collection of personal information from anyone under the age of 18, Good Mood will take the necessary steps to delete the information as quickly as possible, unless required by applicable law to retain it.

 

  1. Data Security
  • The boomfestival.org website is protected by a secure hypertext transfer protocol (HTTPS) which is currently the most secure version of the data transfer protocol between computer networks on the internet, as it encrypts data provided, and guarantees the security of the data sent and received by the User.
  • User and/or Client data registered on Good Mood's servers are always protected by a login and password. Although Good Mood makes every effort, it cannot guarantee the security of the information that is transmitted, namely by intrusion by third parties (hackers).   • Personal Data will not be sold or rented.
  • Data security is guaranteed through appropriate technical and organizational measures.

  • In accordance with applicable law, Good Mood undertakes to respect the confidentiality of your personal information and ensures that you may exercise your rights, namely:
  1. Right to be informed: You have the right to obtain clear, transparent and understandable information about how Good Mood uses your Personal Data. This is why we provide you with this Privacy Policy.
  2. Right to access and data portability: in addition to the right to information, you will be able to access your Personal Data that we process. In these cases, Good Mood will provide you with a copy of the Personal Data that is being processed. Furthermore, when you request it through electronic means, the information will be provided in a commonly used electronic format.
  3. Right to rectification: you have the right to rectify your Personal Data if it is incorrect, out of date or if you wish to complete it. To do so, you can contact us at the above-mentioned contacts or, alternatively, if you have registered on the website boomfestival.org, go to your "reserved area".

  8. Right to restrict the processing of your data: you have the right to request restriction of the processing of your data in the following situations: if you dispute the accuracy of the data, if the processing is unlawful and you do not want to erase your data, but only limit its use, if the data is no longer necessary to Good Mood or if you have exercised the above-mentioned right of objection, during the period of time in which Good Mood analyses whether or not your legitimate interests in the processing prevail over that right.

  1. How long do we store your data
  • Good Mood only keeps Personal Data for the time necessary to achieve the purpose for which it was collected, to respond to your needs or to comply with our legal obligations.
  • To determine how long we keep your data, we use the criteria set out below. If several criteria are applied simultaneously, we will keep your Personal Data in accordance with the criteria that imply the retention of your Personal Data for the longest period:
  1. When purchasing services and/or products, we will retain your Personal Data for the duration of our contractual relationship, including any claims that may arise, as well as for a period of two years after its termination, without prejudice to the fulfilment of legal obligations of the responsible for the processing;
  2. When you contact us with questions, we will retain your Personal Data for as long as necessary to resolve your question;
  3. When you create an account in the reserved area (login), that is, when you register on the website boomfestival.org, we will keep your data until you ask us to delete it;
  4. Once you have consented by sending your disclosure, we will retain your Personal Data until you unsubscribe or ask us to delete it;
  5. The period of time provided for in the applicable legislation; or
  6. Until the specific purpose applicable to certain data ceases to exist.

  • You warrant that the Personal Data that you communicate to Good Mood is correct and accurate, and furthermore undertakes to notify any changes or modifications to this data and assumes exclusive responsibility for damages caused by erroneous, inaccurate or incomplete data communication.
  • You are expressly warned that when disclosing Personal Data via Good Mood's social media platforms, such as Facebook and Instagram, this information may be seen and used by third parties. Good Mood does not read any personal communication published on its visitors' own websites.
